This Acceptable Use Policy (“AUP”) describes prohibited and restricted uses of services offered by TT Phoenix Group LLC, doing business as Phoenix Access. It is incorporated into the Terms of Service.
1. Scope and responsibility
This AUP applies to every Phoenix Access account, subscription, application, network connection, and related service. You are responsible for activity through your account and for anyone you authorize to use it. You must comply with applicable laws, third-party rights, and reasonable network rules.
Phoenix Access is designed for lawful privacy and security purposes. A VPN does not authorize conduct that would otherwise be unlawful or violate another party’s rights.
2. Prohibited activity
You may not use or facilitate use of the Services to:
- commit, promote, solicit, or conceal unlawful activity;
- exploit, endanger, harass, threaten, stalk, defame, or unlawfully discriminate against another person;
- create, obtain, distribute, or promote child sexual abuse material or any sexual exploitation of minors;
- traffic in controlled substances, weapons, stolen goods, credentials, payment data, or other illegal goods or services;
- infringe or misappropriate copyrights, trademarks, trade secrets, privacy, publicity, or other rights;
- send spam, unlawful marketing, phishing, deceptive messages, or communications that conceal or falsify their origin;
- distribute malware, ransomware, spyware, destructive code, credential stealers, botnets, or tools primarily intended for unauthorized compromise;
- gain or attempt unauthorized access to an account, device, system, database, or network;
- conduct denial-of-service attacks, credential stuffing, password spraying, malicious scanning, or exploitation without the system owner’s explicit authorization;
- intercept communications or collect personal information without lawful authority and required consent;
- evade sanctions, export controls, court orders, or lawful geographic restrictions applicable to you;
- impersonate another person, misrepresent affiliation, or use forged or stolen account or payment information; or
- encourage, assist, or provide instructions specifically intended to enable any prohibited activity above.
3. Network and service integrity
You may not interfere with the operation or security of the Services or another network. This includes bypassing account, device, rate, or access limits; probing Phoenix Access systems without written authorization; altering client software to defeat controls; introducing malicious traffic; or using automated methods that materially degrade service for others.
Good-faith security research involving systems you own or are explicitly authorized to test is permitted only when lawful and conducted without routing harmful activity through Phoenix Access infrastructure.
4. Responsible use and resale
Use must be consistent with the personal or business plan purchased. You may not resell, sublicense, share publicly, operate an open proxy, provide exit-node access to others, or use the Services as commercial network infrastructure without our written authorization.
We may apply reasonable technical measures to protect service availability, including connection, device, or resource controls disclosed for the plan. We do not restrict ordinary lawful use solely because it is high bandwidth, but activity that threatens stability, indicates compromise, or materially impairs other users may be limited while investigated.
5. Legal process and urgent harm
We may preserve and disclose information as described in the Privacy Policy when required by valid legal process or reasonably necessary to address imminent risk of death, serious physical harm, child exploitation, fraud, or a significant security threat. We review requests for facial validity and scope where legally permitted.
6. Investigation and enforcement
We may investigate credible reports and use proportionate measures, including warnings, traffic or feature restrictions, temporary suspension, or account termination. We consider severity, intent, recurrence, risk, legal obligations, and impact on others. Urgent threats, fraud, child exploitation, malicious attacks, or material risks may result in immediate action without advance notice.
Where reasonable and lawful, we will notify you of an enforcement action and provide a way to respond. Refund eligibility following suspension or termination is governed by the Refund Policy. We may cooperate with providers and authorities as required by law.
7. Reporting abuse and appeals
Report suspected abuse to ttphoenixgroup@gmail.com with the subject “Abuse Report.” Include relevant dates, timestamps, IP addresses, logs, URLs, and a description of the issue where lawfully available. Do not send passwords, full payment-card numbers, illegal content, or unnecessary personal information.
To appeal an account action, email the same address with the subject “AUP Appeal,” identify the account, explain why the action should be reconsidered, and provide supporting information. We will review the appeal in good faith, but may maintain restrictions needed to comply with law or protect the Services and others.
8. Changes and contact
We may update this AUP as threats, technology, or legal requirements change. Material changes will be posted with a new effective date and additional notice when required.
